Contractor Service Standards & Client Agreement

Terms of Service

Effective Date: October 1, 2026
Operating Entity: Brighton Water Heater Pros, 197 Telluride St #500, Brighton, CO 80601, United States.

Welcome to Brighton Water Heater Pros. These Terms of Service ("Terms", "Agreement") govern all plumbing diagnostic visits, emergency repairs, equipment replacements, maintenance operations, and digital interactions conducted through our website (waterheaterrepairbrightonco.com) and our physical service dispatch facility in Brighton, Colorado. By requesting service, scheduling an appointment, or approving a written estimate, you agree to be bound by these Terms.

1. Scope of Master Plumbing Services

Brighton Water Heater Pros operates as a dedicated, licensed plumbing contractor specializing in residential and commercial water heating equipment. Our scope of practice includes:

  • Emergency diagnostic and mechanical repairs on storage tank and tankless systems.
  • New water heater installation, replacement, high-efficiency upgrades, and equipment sizing.
  • Code-mandated thermal expansion tank installations, pressure regulator valve (PRV) testing, and seismic tie-down compliance.
  • Sediment extraction, power hydro-flushing, descaling, sacrificial anode rod replacements, and safety testing.
  • Combustion safety inspections, manifold pressure tests, and high-altitude burner calibrations.

All plumbing and mechanical services are performed directly by licensed Colorado master plumbers and registered apprentices operating under master plumber supervision, in accordance with Title 12, Article 155 of the Colorado Revised Statutes.

2. Regulatory Compliance & Municipal Building Codes

All installations and major mechanical repairs strictly comply with the International Plumbing Code (IPC), International Fuel Gas Code (IFGC), and local amendments adopted by the City of Brighton Community Development Department, Adams County Building Safety, and Weld County Building Inspection Division.

Where required by municipal law, Brighton Water Heater Pros will pull the necessary municipal plumbing and mechanical permits prior to initiating installation work, and will arrange for the mandatory final inspection with city or county officials. Homeowners agree to provide reasonable access to their premises for municipal building inspectors to complete permit sign-offs.

3. Diagnostic Assessments & Upfront Flat-Rate Pricing

We adhere to a transparent, flat-rate pricing model. Before performing any physical repair or replacement work, our licensed plumber conducts a comprehensive diagnostic evaluation and provides a written, itemized estimate outlining the total cost of parts, labor, and municipal permits.

  • Diagnostic / Trip Fee: A standard diagnostic dispatch fee applies to cover technician travel and multi-point mechanical inspection. If you approve the recommended repair or replacement during the same visit, the diagnostic fee is credited directly toward your total invoice.
  • Written Authorization: No mechanical work will begin without your explicit verbal or written authorization of the quote. You will never encounter unexpected fees, travel surcharges, or hidden line items.
  • Unforeseen Conditions: If our technicians uncover hidden mechanical hazards during the repair (such as degraded galvanized supply pipes, leaking gas shutoff valves, or unpermitted substandard electrical wiring), we will pause work and present an itemized change order for your approval before proceeding.

4. 24/7 Emergency Dispatch & Arrival Windows

We maintain 24-hour emergency dispatch across Brighton, Henderson, Lochbuie, Todd Creek, and surrounding Adams/Weld County communities. While we endeavor to respond to active flood emergencies within 60 to 90 minutes, all estimated arrival windows are subject to severe Colorado weather events (blizzards, icy roadways), hazardous traffic conditions, and technicians attending life-safety emergencies (gas leaks or catastrophic ruptures). Our dispatch office will maintain direct phone or SMS communication regarding any delays.

5. Homeowner & Site Accessibility Responsibilities

To facilitate a safe and efficient service call, the customer agrees to provide:

  • Clear Workspace: A safe, unobstructed workspace around the water heater equipment (minimum 3-foot perimeter free of stored household items, furniture, combustible chemicals, and clutter).
  • Adult Presence: An authorized adult representative (aged 18 or older) on site with legal authority to approve mechanical work, sign work orders, and process payment.
  • Utility Access: Safe access to the main household water shutoff valve, electrical service breaker panel, and natural gas or LP supply meter.
  • Pet Restraint: Secure containment of domestic animals away from the equipment workspace and technician transit routes for technician and pet safety.

6. Payment Terms & Invoicing

Payment is due in full upon completion of services and successful equipment testing. We accept major credit cards (Visa, MasterCard, Discover, American Express), debit cards, ACH bank transfers, and verified company checks. Financing options are available for major equipment replacements through licensed third-party lending partners, subject to credit approval.

Failure to provide timely payment upon job completion may result in late finance charges of 1.5% per month (or the maximum allowed by Colorado law) on outstanding balances, along with reasonable attorney and collection costs. Pursuant to C.R.S. ยง 38-22-101 et seq., contractor mechanic's lien protections apply to all installed real property fixtures.

7. Manufacturer Warranties vs. Workmanship Guarantees

We stand behind our work with clear, dual-layer warranty protections:

  • Manufacturer Equipment Warranty: Water heater tanks, heat exchangers, and manufactured parts carry manufacturer warranties (typically 6 to 10 years for tank systems, and 10 to 15 years for tankless heat exchangers) provided by brands like Bradford White, Rheem, Navien, and Rinnai. We register all equipment on your behalf upon installation.
  • Contractor Workmanship Guarantee: Brighton Water Heater Pros provides a comprehensive 1-year labor guarantee on all professional installations and a 90-day guarantee on minor component repairs. If an installation leak or mechanical assembly error occurs during this period, we will return and resolve it at zero cost.
  • Warranty Exclusions: Warranties do not cover damage caused by homeowner negligence, unapproved third-party modifications, catastrophic freezes due to unheated basements, municipal pressure spikes above 80 PSI where the customer refused a pressure reducing valve, or severe calcification resulting from failure to flush hard water scale.

8. Regional Water Hardness & High Altitude Factors

Customers acknowledge that Brighton municipal tap water contains 12 to 18 grains per gallon (GPG) of mineral hardness, and regional elevation sits near 5,000 feet above sea level. These natural environmental factors impact water heating equipment:

  • High altitude naturally reduces combustion oxygen by ~15%, requiring our plumbers to calibrate gas manifold pressure and install high-altitude burner orifices to prevent soot buildup.
  • Hard water scale accelerates sediment accumulation. Homeowners must adhere to recommended annual sediment flushes or install whole-home water softening to maintain factory efficiency and avoid premature tank rupture.

9. Limitation of Liability & Pre-Existing Property Damage

Brighton Water Heater Pros carries comprehensive $1,000,000 commercial liability insurance and statutory workers' compensation coverage for your complete protection. However, our liability is subject to reasonable commercial standards:

  • We are not liable for pre-existing water damage, rotted structural subflooring, mold growth, or electrical corrosion that occurred prior to our technician's arrival due to delayed homeowner discovery or long-term leaking.
  • We are not responsible for brittle, fragile water supply pipes, corroded galvanized fittings, or deteriorated gas lines that rupture when standard mechanical wrench torque is applied during necessary component removal.
  • Our aggregate liability for any claim arising out of our services is strictly limited to the total monetary amount paid by the customer for the specific service order under dispute.

10. Cancellation & Right of Rescission

Customers may cancel or reschedule a non-emergency appointment without penalty by providing at least four (4) hours' advance notice before the scheduled arrival window. Cancellations made after a service technician has already been dispatched to your property may be subject to our standard diagnostic trip charge.

For planned residential replacements solicited or signed at the homeowner's residence, Colorado and federal consumer protection statutes provide a three-day right of rescission, unless the customer signs an emergency repair waiver requesting immediate hot water restoration.

11. Hazardous Site Conditions & Right to Refuse Service

Our technicians reserve the right to temporarily pause or refuse service if hazardous environmental conditions are encountered that jeopardize life safety. Such conditions include active natural gas leaks, carbon monoxide concentrations exceeding OSHA thresholds, exposed asbestos flue insulation, severe biohazards (raw sewage accumulation), structural floor collapse hazards, or verbal/physical hostility. In such instances, service will resume once the hazard has been remediated.

12. Governing Law, Jurisdiction & Severability

These Terms of Service are governed by, construed, and enforced in accordance with the laws of the State of Colorado, without regard to conflict of law principles. Any legal proceeding, dispute, or claim arising from these Terms or our plumbing services shall be initiated exclusively in the state courts located in Adams County, Colorado. If any provision of this Agreement is deemed unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
